Possible congressional intervention. Given the high costs of
complying with the O’Bannon ruling as well as the complexity and uncertainty
associated with antitrust challenges to its student-athlete eligibility rules,
the NCAA might seek a congressional exemption from antitrust law, which would permit
the NCAA and its member institutions to spend the substantial revenues
generated from intercollegiate athletics in other ways, including increased
educational support for all student-athletes. If you were a member of Congress,
what assurances or conditions would you require from the NCAA in exchange for
the granting of an exemption immunizing its student-athlete eligibility rules
from antitrust challenge?
