Driver Johnny Joe Milton has compiled an enviable record on
the National Association of Stock Car Auto Racing (NASCAR) circuit since
joining the Il Penseroso racing team two years ago. In fact, he has been so
successful that he has attracted the attention of other race team owners,
including Claude Forsooth. Despite the fact that Johnny has a year remaining on
his three-year contract with Il Penseroso, not to mention two one-year options
exercisable by Il Penseroso, Johnny agrees to leave that team and join Forsooth
and his Formula One racing team. Though Johnny regrets leaving the NASCAR
circuit, he looks forward to the new challenges of Formula One. He will race
mainly in Europe in Grand Prix events, but will also be in the United States
for such races as the Indianapolis 500 and two or three other similar events.
Il Penseroso’s owner, Alfonse Allegro, is not about to allow Johnny to leave
his team that easily. He points to wording in his written contract with Johnny whereby
Johnny promises to render “his race driving services exclusively” to Il
Penseroso for the term of the contract. Allegro files suit against Johnny for
breach of contract and seeks a worldwide injunction to restrain him from racing
for Forsooth for the three-year remaining duration of his contract. Considering
