Analyzing O’Bannon. Should the NCAA’s rules barring student-athletes
from receiving a share of the licensing revenues generated from products using
student-athletes’ names, images, and likenesses violate §1? Is preservation of
amateurism a legitimate procompetitive economic objective or merely a factor in
determining whether these rules have a procompetitive effect? What issues do
all three judges agree on and what is the issue upon which the two-judge
majority disagrees with the dissenting judge? If the dissent prevailed on this
issue, what would the implications be for NCAA member institutions playing at
this level?
